1. Acceptance of Terms

By accessing, browsing, registering for, or using our website, mobile application, and related services (collectively referred to as the "Service" or "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must immediately cease all use of the Platform. These Terms constitute a legally binding agreement between you ("User," "Member," or "Viewer") and the operators of xlovecam.

We reserve the right, at our sole discretion, to modify, update, or alter these Terms at any time without prior notice. Any changes will be effective immediately upon posting to this page. It is your responsibility to review these Terms periodically. Your continued use of the Platform following the posting of any changes constitutes your unconditional acceptance of those changes.

2. Eligibility and Age Requirements

The xlovecam Platform contains sexually explicit material and adult content. By accessing this website, you solemnly swear and affirm under penalty of perjury that you are at least eighteen (18) years of age, or the legal age of majority in your jurisdiction, whichever is greater. You also affirm that accessing adult content is legal in your geographic location and that you are not violating any local, state, national, or international laws by doing so.

We strictly prohibit minors from accessing or using our services. If we discover or have reasonable suspicion that an account belongs to a minor, or that a minor is accessing the Platform, we will immediately terminate the account and block access without notice. We utilize advanced age-verification mechanisms and actively cooperate with law enforcement to prevent underage access.

3. Account Registration and Security

To fully experience the interactive features of xlovecam, including private shows, tipping, and messaging, you must create a user account. You agree to provide accurate, current, and complete information during the registration process. You are strictly prohibited from creating an account using a false identity, impersonating another person, or using a temporary email address.

You are solely responsible for maintaining the confidentiality and security of your login credentials (username and password). You agree to accept full responsibility for all activities, charges, and damages that occur under your account. If you suspect that your account has been compromised or accessed without your authorization, you must immediately notify our 24/7 customer support team. xlovecam will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Virtual Credits and Financial Transactions

The xlovecam Platform utilizes a virtual currency system ("Credits") that allows users to interact with performers, request private shows, send virtual gifts, and access premium media. Credits can be purchased using real currency through our secure, third-party payment processors. All transactions are billed discreetly to protect your privacy.

No Refunds: All purchases of virtual Credits are final and non-refundable. Once Credits have been added to your wallet, they cannot be exchanged back for real-world currency. If your account is suspended or terminated due to a violation of these Terms, you will forfeit any remaining Credit balance, and no compensation will be provided.

Chargebacks and Fraud: Any attempt to initiate a fraudulent chargeback or dispute a valid transaction with your bank or credit card provider will result in the immediate and permanent ban of your account. We reserve the right to pursue legal action and share your information with credit reporting agencies and fraud prevention networks in the event of suspected financial fraud.

5. Acceptable Use and Prohibited Conduct

At xlovecam, we are committed to maintaining a safe, respectful, and consensual environment for both our users and our broadcasting models. By using the Platform, you agree to conduct yourself in a polite and lawful manner. You strictly agree NOT to engage in any of the following prohibited activities:

• Harassment and Abuse: You may not threaten, bully, dox, stalk, or harass any performer or fellow user. Hate speech, racial slurs, and derogatory language will result in an instant, unappealable ban.
• Unauthorized Recording: Using screen capture software, external cameras, or any other method to record, download, or distribute live streams or private shows is strictly forbidden. All content is protected by copyright.
• Solicitation and Spam: You may not use the chat functions to advertise third-party websites, solicit external payments, or bypass the xlovecam payment system to contact models directly.
• Illegal Content: You may not request, encourage, or share content that involves violence, non-consensual acts, bestiality, or the exploitation of minors.

Our moderation team monitors public and private chat rooms 24/7. We reserve the right to suspend or terminate your account without warning if you are found violating any of these community guidelines.

6. Intellectual Property Rights

All content, materials, software, algorithms, designs, text, images, photographs, video, audio, and graphics present on the xlovecam Platform are the exclusive property of xlovecam, its affiliates, or its licensed performers. This content is protected by international copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and view the content for your personal, non-commercial use only. You may not reproduce, modify, distribute, display, perform, or create derivative works from any part of the Platform without our express written consent. Any unauthorized use of the platform's intellectual property will result in aggressive legal action and account termination.

7. Broadcaster and Performer Rules

Performers broadcasting on xlovecam are independent contractors and are not employees, agents, or representatives of the platform. The views, opinions, and actions of the performers are solely their own and do not necessarily reflect the policies or views of xlovecam. Performers set their own rates for private shows, tip menus, and exclusive content.

We mandate that all performers verify their age and identity using stringent KYC (Know Your Customer) compliance protocols before they are allowed to broadcast. However, users interact with performers at their own risk, and xlovecam does not guarantee the accuracy of any statements or claims made by broadcasters during their live streams.

8. Disclaimers of Warranty

The xlovecam Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, completely secure, or free from viruses or other harmful components. We do not guarantee the quality, stability, or reliability of any live stream, as these rely on third-party internet service providers and the hardware capabilities of individual performers. Your use of the Platform is entirely at your own risk.

9. Limitation of Liability

In no event shall xlovecam, its directors, officers, employees, affiliates, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of or inability to use the Service. This includes, without limitation, damages for loss of profits, loss of data, emotional distress, or business interruption, regardless of the legal theory asserted.

Our total cumulative liability to you for any and all claims arising from your use of the Platform shall not exceed the total amount of money you have paid to xlovecam in the three (3) months preceding the incident giving rise to the liability. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless xlovecam and its affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your use or misuse of the Platform, your violation of these Terms and Conditions, or your violation of any rights of any third party, including intellectual property rights or privacy rights.

11. Governing Law and Dispute Resolution

These Terms and Conditions, and any disputes arising out of or related to your use of the Platform, shall be governed by and construed in accordance with the laws of the jurisdiction in which the company operating xlovecam is headquartered, without regard to its conflict of law provisions.

Any legal action or proceeding relating to your access to or use of the Service must be instituted in a state or federal court located in the aforementioned jurisdiction. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding. We strongly encourage users to contact our customer support team to seek a resolution before initiating formal legal proceedings.
